Terms and Conditions

These Terms and Conditions (“Terms”) govern the sale of Border Collie puppies and any associated services offered by Prime Collies Australia (“we”, “us”, “our”) through the website primecolliesaustralia.com. By placing a reservation, paying a deposit, or completing a purchase, you (“the Buyer”) agree to be bound by these Terms.
1. Pricing and Payment
1.1 All prices are listed in Australian Dollars (AUD) and are inclusive of GST where applicable.
1.2 Full payment is required prior to the puppy being released to the Buyer.
1.3 Accepted payment methods are listed at checkout. Payments must clear before pickup or transport is arranged.
2. Reservations and Deposits
2.1 A non-refundable deposit of [AMOUNT, e.g. $500] is required to reserve a puppy from a current or upcoming litter.
2.2 Deposits secure your place on the waiting list but do not guarantee any specific puppy until allocation, which occurs at approximately [e.g. 6 weeks of age].
2.3 Deposits may be transferred to a future litter at our discretion if a suitable puppy is not available in your reserved litter.
3. Health Guarantee
3.1 Each puppy is sold in good health and undergoes a veterinary examination prior to leaving our care.
3.2 We provide a 1-year guarantee against severe hereditary or congenital conditions that materially impact the dog’s quality of life. To make a claim, the Buyer must provide a written diagnosis from a registered Australian veterinarian.
3.3 The Buyer is responsible for the puppy’s ongoing health, vaccinations, parasite prevention, and welfare from the date of collection.
3.4 This guarantee does not cover conditions caused by injury, neglect, poor diet, or environmental factors after the puppy leaves our care.
4. Pickup, Transport and Delivery
4.1 Puppies may be collected in person from our property in Darwin, NT, by prior appointment.
4.2 If transport is required, we will assist in arranging a professional pet transport service at the Buyer’s cost.
4.3 Once a puppy is in the care of a transport provider, we accept no further responsibility for delays, incidents, or losses caused by the transport company.
5. Microchipping, Vaccination and Registration
5.1 All puppies leave our care microchipped, vaccinated (age-appropriate), wormed, and vet-checked.
5.2 Microchip details are transferred to the Buyer at the time of sale. The Buyer is responsible for keeping these details up to date with the relevant pet registry.
5.3 Registration with state or territory pet registries is the responsibility of the Buyer.
6. Returns and Refunds
6.1 As live animals, puppies cannot be returned for change of mind.
6.2 If the Buyer can no longer care for their puppy at any point in its life, we ask to be contacted first. We will always assist in finding the dog a suitable home rather than seeing it surrendered to a shelter.
6.3 Refunds are not provided except as required under the Australian Consumer Law.
7. Buyer Responsibilities
7.1 The Buyer agrees to:
• Provide a safe, loving home environment suitable for an active, intelligent working breed
• Maintain regular veterinary care, vaccinations, and parasite prevention
• Provide appropriate training, exercise, and mental stimulation
• Never resell, surrender, or rehome the puppy without first contacting us
• Never use the puppy for unethical breeding, fighting, or commercial resale to third parties
8. Limitation of Liability
8.1 To the extent permitted by law, our liability under these Terms is limited to the purchase price paid for the puppy.
8.2 We are not liable for any indirect, consequential, or incidental losses including but not limited to veterinary expenses beyond the scope of clause 3.
9. Privacy
9.1 Personal information provided by the Buyer is collected and used in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).
9.2 We do not share buyer information with third parties except as required to deliver the puppy (e.g., transport providers) or to comply with legal obligations.
10. Governing Law
10.1 These Terms are governed by the laws of the Northern Territory, Australia.
10.2 Any disputes shall be resolved through good-faith negotiation in the first instance and, failing resolution, in the courts of the Northern Territory.
11. Variation
11.1 We may amend these Terms from time to time. The version published on this website at the time of purchase is the version that governs the sale.
